These Terms & Conditions ("Terms") govern your access to and use of Darwinbark Technologies Pvt. Ltd.'s websites, the Darwinbark @core CMS/Website Builder platform, and related services (collectively, the "Services"). By using our Services, you agree to these Terms.

1. Using Our Services

You must be at least 18 years old, or have the consent of a parent/guardian, to use our Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. Accounts & Subscriptions

• Some features require a paid subscription or one-time purchase. Prices and features are described on our website or order page at the time of purchase.
• Subscriptions renew automatically unless cancelled before the renewal date, where applicable.
• We may suspend or terminate accounts that violate these Terms, engage in fraud, or misuse the Services.

3. Acceptable Use

You agree not to use the Services to:

• Upload or distribute unlawful, infringing, defamatory, or malicious content.
• Send spam or unsolicited bulk messages, including via WhatsApp/email integrations.
• Attempt to gain unauthorized access to our systems or another user's account.
• Reverse-engineer, resell, or misuse the platform outside the scope of your license/subscription.

4. Your Content

You retain ownership of the content, websites, and data you create using our Services. You grant Darwinbark a limited licence to host, store, and display that content solely to provide the Services to you. You are responsible for ensuring you have the rights to any content you upload.

5. Intellectual Property

The Darwinbark platform, including its software, themes, templates, and branding, is owned by Darwinbark Technologies Pvt. Ltd. and protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of our platform to you.

6. Payments & Refunds

Fees are charged as described at checkout. Please review our Refund Policy for details on cancellations and refunds.

7. Service Availability

We aim to keep our Services available and reliable but do not guarantee uninterrupted access. We may perform maintenance, updates, or changes to features from time to time.

8. Limitation of Liability

To the maximum extent permitted by law, Darwinbark shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services. Our total liability for any claim is limited to the amount you paid us in the preceding 12 months.

9. Termination

You may stop using our Services or close your account at any time. We may suspend or terminate access for breach of these Terms, with notice where reasonably possible.

10. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

11. Changes to These Terms

We may revise these Terms periodically. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
